These Terms & Conditions apply to your use of the Casa website, Casa Designer platform, and any engagement with Casa Home Design Pty Ltd (“Casa”, “we”, “our”, or “us”).
1. Role of Casa
Casa is not a registered builder and does not directly carry out building work.
Casa acts as a design, coordination, and build partner, working with a network of licensed and insured Western Australian builders to deliver Casa homes.

The building contract is always entered into directly between you (the owner) and the selected builder.
2. Building Contracts & Legal Protections
All Casa homes are delivered under a standard Housing Industry Association (HIA) building contract, entered into directly between the customer and the builder.
This ensures customers receive full protection under Western Australian law, including:
- Home Indemnity Insurance (HII) (where applicable under WA thresholds)
- Public Liability Insurance held by the builder
- Workers Compensation Insurance held by the builder
- Statutory warranties under the Building Act 2011 (WA) and Home Building Contracts Act 1991 (WA)
- Compliance with the National Construction Code (NCC) and all applicable WA regulations
Casa does not replace, override, or limit any rights you have under these laws or contracts.
3. Pricing & Estimates
Any pricing shown through the Casa Designer or provided by Casa:
- Is indicative until finalised in the HIA building contract
- Reflects standard inclusions and selected upgrades
- Excludes site-specific, council, or authority costs unless explicitly stated
Final pricing is confirmed only in the signed building contract between you and the builder.
4. Builders & Delivery
Casa works exclusively with licensed WA builders who meet Casa’s quality, insurance, and delivery standards.
While Casa assists with coordination and consistency, the builder is responsible for construction, site safety, workmanship, and compliance.

Any construction timelines provided are estimates only and may be affected by approvals, site conditions, weather, supply availability, or regulatory delays.
5. Approvals & Permits
Building permits, certifications, and approvals are issued under the builder’s registration and in accordance with WA legislation.
Casa may assist with coordination but does not act as the permit applicant unless expressly agreed in writing.

6. Design & Documentation
All designs, layouts, specifications, and materials presented by Casa remain subject to:
- Engineering
- Certification
- Council or building surveyor requirements
Minor design or specification changes may be required to achieve compliance without materially affecting the intent of the design.
7. Use of the Casa Designer
The Casa Designer is provided to help customers explore options and understand pricing.
Use of the Designer does not create a binding agreement to build, and selections may be refined prior to contract signing.

8. Limitation of Liability
To the maximum extent permitted by law:
- Casa is not liable for construction defects, delays, or workmanship issues, which remain the responsibility of the builder under the HIA contract
- Nothing in these Terms limits your rights under Australian Consumer Law or WA building legislation
9. Intellectual Property
All Casa designs, plans, branding, and digital content remain the intellectual property of Casa unless otherwise agreed in writing.
10. Changes to These Terms
Casa may update these Terms & Conditions from time to time. The most current version will always be published on our website.
11. Governing Law
These Terms & Conditions are governed by the laws of Western Australia, and any disputes are subject to the jurisdiction of WA courts.
